A. Call to Order
Schreiber called the meeting to order at 7:32 p.m.

D. New Business
1. Requesting modification of File #W2004-06 – Application for a 3-lot subdivision on
property located at 61 Mihaliak Road (Map 45, Lot 1). Owner/Applicant: Mary
Litwinczyk. (Received 7/12/04; Decision by 9/13/04.)
Ed Pelletier of DATUM Engineering said there are very few changes. He proposed a drainage easement on Lot #1. He said that water will be kept off the road with a grass swale. He said a level spreader will be used on Lot #2. He pointed out another swale and a pipe under the driveway. He said that the town engineer and the Public Works Department agreed that using grass swales would be an efficient way to keep water off the road. Mr. Pelletier pointed out the paved apron that’s within the regulated area.
Jones gave Schreiber a letter from Karl Acimovic.
Calvert joined the meeting at this time (7:37 p.m.)
Schreiber said we approve of grassy swales if they are well-maintained.
Mr. Pelletier said that both swales will be constructed for easy mowing.
Dirrigl asked if sanitation approval has been received for the level spreader, and Mr. Pelletier replied that it shouldn’t be a problem.
MOTION: To approve File #W2004-06 with modification to the plan with the
condition that the Health Department grant approval for the
modification.

2. File #W2004-19 – Application to construct single family home with driveway and
wetland crossing within a regulated area on Mason Road (Map 6, Lot 14). Owner/
Applicants: Eugene & Stephen Wasynczuk. (Received 7/12/04; Decision by 9/13/04.)
This application was just received tonight; discussion was tabled.

F. Old Business
1. File #W2004-17 – Application to modify and extend original wetlands permit #97-020
to add a 26’ x 38’ addition to existing 4000 sq. ft. building at 25 Village Hill Road
(Map 39, Lot 12). Owner/Applicant: Robert Whalen, Mycoscience, Inc. (Received
6/28/04; Hearing/Decision by 7/26/04.)
Jones read information concerning this application from the minutes of the last meeting. He showed the original 4,000 sq. ft. plan as well as the original 5,000 sq. ft. plan, and where the slab addition will be placed. He said it was “pretty close” to the original footprint that we approved.
MOTION: To seat Calvert for Metzler.

2. File #W2004-18 – Application for declaratory ruling of no impact for 3-lot
subdivision as Phase I for property at Tinkerville & Lustig Roads (Map 36, Lot 12).
Owner: Meredith Fuentes; Applicant: Mansour Developers. (Received 6/28/04;
Decision by 7/26/04.)
Doug Ellis from Buck & Buck said they would like to subdivide two lots and have the remainder as Lot 3. He explained the rationale of this request. He said there would be no wetlands impact for Phase I. He said the alternative would be to have 13 lots.
Jones said that these are preliminary plans. The Health District asked for the systems to be shifted since they were too close to the driveway cut.
Mr. Ellis pointed out the wetlands and steep slopes. He said the proposed driveway was off the new roads. He said there are 37.6 acres for Lot 3.
Schreiber said it looked like there would be no impact to the wetlands for Phase I, but we will have questions on Phase II. He said the Commission doesn’t like to see septic systems inside the setback, and we don’t want to set precedents. He said that impervious surfaces should be kept to a minimum within the setbacks.
Jones mentioned several items the applicant would have to consider for Phase II.
Schreiber asked about the time schedule for Phase II, and Mr. Ellis replied September or October.
MOTION: No jurisdiction for File #2004-18 as presented.

3. File #W2003-44 Notice of Violation – Filling of a wetlands and grading and filling
activity within the upland review area without permits on property located at 315
Daleville Road (Map 7, Lot 10B). Owner: Harold W. III & Rene Bruce; Contractor:
All-Phase Enterprises, Inc.
Jones said they are starting to seed in the area. A small pile of pipes has to be moved.
4. File #W2003-49 – Notice of Violation: TravelCenters of America (the Lessee) and
George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Rd.
Not discussed.
5. File #W2004-11 – Notice of Violation – Maintaining a stump pile, stockpile of
potential topsoil, and compacted brush storage pile within a wetland and upland
review area on Clover Springs Farm Subdivision Phase II property located off
Battye Road (Map 9, Lot 7). Owner: Joseph Voboril.
Not discussed.
